1. Introduction

Welcome to FlyHi Media Group’s website (the "Site"). These Terms of Service ("Terms") govern your use of our Site and any services provided by FlyHi Media Group ("Company," "we," "us," or "our"). FlyHi Media Group provides real estate photography and media services in San Antonio, Texas, including but not limited to photography, videography, drone footage, virtual tours, and floor plans ("Services"). All Services are subject to availability and may have additional terms and conditions.

3. Booking and Payment

3.1 Booking: Clients can book our Services through our Site, via phone, or email. All bookings are subject to confirmation and availability.

3.2 Payment Terms: Payment for Services is due upon receipt of the final invoice, unless otherwise agreed in writing. We accept various payment methods as listed on our Site.

3.3 Cancellations and Rescheduling: While we do not charge cancellation fees, we appreciate prompt notification if you need to cancel or reschedule a booking.

4. Use of Media

4.1 Ownership: FlyHi Media Group retains full ownership of all media (photographs, videos, etc.) produced during the course of our Services.

4.2 License for Use: Upon full payment, clients are granted a non-exclusive, non-transferable license to use the media for personal or business marketing purposes only. No other use is permitted without prior written consent from FlyHi Media Group.

4.3 Third-Party Use: Clients are not permitted to sell, license, or provide any media produced by FlyHi Media Group to third parties under any circumstances.

5. Client Responsibilities

5.1 Access and Preparation: Clients must ensure that properties are accessible and in a condition suitable for photographing or filming at the scheduled time. This includes tidying and staging as necessary.

6. Liability and Indemnification

6.1 Limitation of Liability: FlyHi Media Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.

6.2 Indemnification: You agree to indemnify, defend, and hold harmless FlyHi Media Group, its officers, directors, employees, and agents, from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services or any violation of these Terms.

7. Modifications

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site and Services following the posting of changes constitutes your acceptance of such changes.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in San Antonio, Texas.
